In France, the principle is one of freedom of pricing. In theory, every company is free to set its prices as it sees fit, in accordance with article L.410-2 of the French Commercial Code. This is a pillar of our market economy and of free competition. However, this freedom is not absolute. To preserve fair competition and protect both consumers and the businesses themselves (particularly the smallest), the law prohibits certain pricing practices deemed to be destabilising or abusive. Among the best-known and most closely monitored prohibitions are resale at a loss and the imposition of minimum prices. Although distinct, these two practices have a direct impact on companies' pricing strategies, particularly in the distribution sector.
