Legal Metrology
Learning Objectives
Upon completion of this course, participants will be able to:
- Understand the regulatory framework applicable to measuring instruments (Decree no. 2001-387 of 3 May 2001)
- Identify the four obligations incumbent on holders of measuring instruments
- Organise control operations throughout the lifecycle of an instrument
- Anticipate and manage a DREETS/DGCCRF inspection
- Assess criminal liability risks and implement preventive measures
Module 1 – Legal Framework and Obligations
- The founding text: Decree no. 2001-387 of 3 May 2001
- The four obligations of the instrument holder:
- Fitness for purpose (range, measuring interval, accuracy class)
- Accuracy (maximum permissible errors)
- Proper maintenance (periodic revision, preventive maintenance)
- Correct operation (immediate withdrawal in the event of malfunction)
- Control operations: initial verification, installation verification, in-service controls (periodic verification, periodic revision, holder’s own checks)
- Marks and stickers: green sticker (compliant), red sticker (rejected)
- The metrological logbook: mandatory content, record-keeping rules, common pitfalls
- Obligations relating to pre-packages (Decree no. 78-166 of 31 January 1978)
Module 2 – Mapping Sensitive Areas
- Identifying risk zones within the business
- Instruments concerned: scales, weighbridges, dosing equipment, pre-packages
- Sector-specific points of vigilance (food industry, manufacturing)
Module 3 – Inspection Bodies and Conduct of Inspections
- DREETS and DGCCRF: competence, investigative powers
- How an inspection unfolds in practice: notification, on-site verification, official report
- Follow-up: compliance measures, administrative sanctions
Module 4 – Risks and Sanctions
- Criminal liability of the director and the company
- Sanctions: fines, confiscation, closure
- Reputational risk
- Preventive measures: internal audit, compliance plan
